PLEASE READ THIS AGREEMENT CAREFULLY

I acknowledge that participating in Playcious programs (parties and/or general admission), involves use of different equipment / play structures, creates a risk of injury, property damage, and death. To help ensure safety of children and prevent injuries caused by unsafe use of the equipment, parents and guardians must always closely supervise their children of all ages. It is, therefore, we advertise Playcious as a parent-supervised facility. Moreover, to minimize or/and prevent the risks of slipping, it is made mandatory that all children older than 1 year, wear Grip Socks.

RELEASE OF LIABILITY, WAIVER OF CLAIMS, COVENANT NOT TO SUE AND IDENTITY AGREEMENT

In consideration of Playcious accepting my application to participate in its programs, I agree; i) To give up my rights to sue Playcious and others associated with it (such as agents, owners, shareholders, directors, partners, employees, volunteers, manufacturers, participants, lessors, its subsidiaries, related and affiliated entities, successors and assigns) and agree to waive all my claims against them that I and/or my next of kin, heirs, executors, administrators and assigns may have in the future against Playcious and others due to injuries or losses of any kind that I/we might suffer while at Playcious facility; ii) To release Playcious and others from any and all liabilities for any of the risks involved while at Playcious facility. In short, I will not recover any money from Playcious for lost and/or stolen items and if I am hurt emotionally or physically while participating in any or all activities at Playcious.

By signing this document, I waive certain legal rights, including the right to sue Playcious and others associated with it. I am signing this document on behalf of all persons listed above and my signatures are binding upon them too.

COVID-19 RISKS  

COVID-19 virus is extremely contagious and is known for its rapid spread through human contacts. Consequently, governmental authorities at all levels have recommended various measures and prohibited a variety of behaviors to reduce the spread of the virus. Playcious is committed to comply with the requirements and recommendations of the public health department and other governmental authorities. Following those guidelines, Playcious has put in place and adopted all necessary measures for the health and safety of all our guests and staff. However, please make a note that Playcious cannot guarantee that you or your child will not be exposed to or become infected with COVID-19. Moreover, attending our facility could increase your and your child’s risk of contracting COVID-19, despite all preventative measures put in place.

By signing this document, I voluntarily assume the risk that me and my child could be exposed to or infected by COVID-19 while being at Playcious facility. I am aware of the risks, dangers and hazards associated with COVID-19 and I freely accept and fully assume, on behalf of myself, my child(ren) and all my accompanying relatives / friends / guests, all such risks, dangers and hazards, including the possibility of illness, permanent disability, or death. Furthermore, I acknowledge and confirm that I am willing to accept these risks, dangers and hazards as a condition of participating in Playcious programs.

I understand that while present in the facility, my child(ren) will be in contact with other children, guests and employees who are also at risk of community exposure. I understand that no list of restrictions, guidelines or practices will remove 100 percent of the risk of exposure to COVID-19.

CODE OF CONDUCT

I agree to follow and abide by the rules set forth by Playcious and use good judgement and act in a responsible manner to ensure safety for myself, child, and those I am responsible for. I understand that it is my sole responsibility to supervise every activity of my child(ren) while at Playcious facility. Playcious has the right to refuse admission or ask me and my child(ren) to leave if equipment is being used improperly or in an unsafe manner. I give Playcious permission to use any pictures taken of my child and/or myself for promotional use.

If for any reasons any of this Agreement is found to be unenforceable, the remaining portions shall remain in full force and effect. 

I am fully aware of the content of this Agreement and have read and understood all the terms.  The terms of this agreement bind me, my family (including but not limited to spouses and domestic partners) heirs, executors, administrators, dependents, beneficiaries, and assigns to follow all terms mentioned in it. By signing this document, I waive certain legal rights, including the right to sue Playcious and others associated with it. I am signing this document on behalf of all persons listed above and my signatures are binding upon them too.

If a child has an accident due to lose diaper or not wearing a diaper, urinating, or vomiting, accompanying parents / guardians will be responsible to clean and sanitize the affected areas of the playground. Playcious reserves the right to charge child’s parents / guardians for any sanitization costs in the event of such accidents.

 If I opt not signing this waiver, I will not be allowed to enter the Playcious facility.
